Gym13 – Terms & Conditions

These Terms & Conditions (“Terms”) govern the use of the facilities, services, classes, personal training, and memberships provided by Gym13 (“Gym13”, “we”, “us”, “our”). By purchasing a membership, day pass, class, or personal training session, or by entering our premises, you (“Member”, “Guest”, “you”, “your”) agree to be bound by these Terms.

1. Definitions

  • Membership: Any recurring or fixed‑term contract providing access to Gym13 facilities/services.

  • Session: Any booked time including personal training (PT), coaching, classes, or consultations.

  • Minimum Term: The minimum commitment period for certain memberships (if applicable).

  • Cooling‑Off Period: Statutory period for distance contracts (see 7.6).

  • PAR‑Q: Physical Activity Readiness Questionnaire.

2. Eligibility & Health

2.1 Age: Standard access from age 16+. Under‑16s are not permitted unless expressly authorised in writing and supervised in a booked 1‑to‑1 session.

2.2 Health Declaration: You confirm you are fit to exercise and will complete a PAR‑Q truthfully. You must inform us of any medical condition, injury, pregnancy, or change in health that may affect your ability to train. We may require medical clearance.

2.3 Assumption of Risk: Exercise involves inherent risks. You accept full responsibility for your participation and use of equipment, following staff guidance and posted instructions at all times.

3. Access & Conduct

3.1 Access Control: Entry is permitted only during staffed hours or authorised supervised sessions

3.2 Code of Conduct:

  • Train safely and re‑rack weights; wipe down equipment after use.

  • No doping substances, alcohol, or illegal drugs on premises.

  • Suitable footwear and attire required.

  • Abusive, threatening, discriminatory, or unsafe behaviour is prohibited.

  • Follow staff instructions and posted rules.

3.3 Guests: Guests must register, accept these Terms, and may be refused entry at our discretion.

3.4 Pets: No animals except certified assistance dogs.

4. Memberships, Passes & Bookings

4.1 Membership Types: [Monthly rolling] | [Fixed‑term] | [Class packs] | [Day passes]. Details, inclusions, pricing, and Minimum Terms are shown at purchase and on [www.gym13.co.uk].

4.2 Bookings: Sessions (classes/PT/coaching) must be booked in advance via [Gymcatch] or our appointed platform. You are responsible for ensuring your booking is correct.

4.3 Session Start Times: Please arrive 5–10 minutes early. Late arrivals may reduce session time without refund.

4.4 Capacity & Scheduling: We may adjust class caps, timetables, or instructors to maintain safe operation.

5. Fees & Payments

5.1 Pricing: Current prices are displayed on [www.gym13.co.uk] and/or at the point of purchase. Prices may change with notice (§16).

5.2 Billing: Memberships renew automatically (where applicable). You authorise recurring charges to your chosen payment method.

5.3 Failed Payments: We may suspend access for overdue balances and charge a reasonable admin fee for failed or late payments.

5.4 VAT: Fees include VAT where applicable.

6. Cancellations, No‑Shows & Lateness (Sessions)

Standard Policy: 24‑Hour Cancellation Window

6.1 Member‑Initiated Cancellations: You may cancel or reschedule any booked PT, coaching, or class session up to 24 hours before the scheduled start time via the booking platform.

  • Within 24 hours: The session is non‑refundable and non‑transferable.

  • No‑show: Charged in full / session forfeited.

6.2 Emergencies: At our sole discretion, and on production of reasonable evidence, we may waive charges for genuine emergencies (e.g., sudden illness).

6.3 Coach/PT Cancellations: If we cancel a session, you will be offered a reschedule or a refund/credit at your choice.

6.4 Lateness: Arrivals >10 minutes late may be refused for safety reasons; the session may be forfeited without refund.

7. Membership Changes, Freezes & Termination

7.1 Upgrades/Downgrades: Subject to availability and pro‑rata adjustments.

7.2 Freeze: You may request a freeze for [minimum 1 month, maximum 3 months] due to injury, or illness,

7.3 Member Termination (Rolling): Rolling memberships may be cancelled with [30 days’ notice] aligned to your billing cycle unless otherwise stated at sign‑up.

7.4 Member Termination (Fixed‑Term): Fixed‑term memberships cannot be cancelled early except for:

  • Relocation >[15] miles from the gym (proof required),

  • Long‑term illness/injury (medical note required),
    Reasonable admin fees may apply.

7.5 Our Right to Terminate: We may suspend or terminate membership immediately for: serious or repeated breach of these Terms, unsafe conduct, harassment/abuse, non‑payment, fraud, or misuse of access.

7.6 Cooling‑Off (Distance Sales): If you join online (not on‑site), you may cancel within 14 days of purchase for a refund of unused services. If you have already used the facilities/sessions within that period, a fair deduction for those services will apply.

8. Facilities, Maintenance & Closures

8.1 We aim to keep facilities fully operational, but machines may be unavailable for maintenance or repair.

8.2 We may temporarily close areas of the gym (or the whole facility) for cleaning, refurbishment, staff training, health & safety, adverse weather, or events beyond our control. For closures exceeding 7 consecutive days, we will offer a pro‑rata credit or extension.

9. Personal Belongings & Lost Property

9.1 Bring only what you need. Do not leave items overnight.

9.2 We are not liable for loss, theft, or damage to personal property, including vehicles in the car park, except where required by law (12).

9.3 Unclaimed lost property may be disposed of after 30 days.

10. Safety, Supervision & Instruction

10.1 Inductions: Ask for an induction if you are unfamiliar with equipment. You must use equipment correctly.

10.2 Spotting & Loads: Use spotters for heavy lifts. Collars/clips on barbells are recommended.

10.3 Cleanliness: Wipe down equipment after use. Bring a towel. Use bins provided.

10.4 Medical Events: In an emergency, alert staff immediately. We may call emergency services and/or administer first aid.

11. Data Protection & CCTV

11.1 We process personal data in line with UK GDPR and the Data Protection Act 2018. See our Privacy Notice at [www.gym13.co.uk/privacy] for details on lawful bases, retention, and your rights.

11.2 CCTV operates for security and safety. Footage may be shared with law enforcement where lawful.

11.3 Booking systems and payment processors are third‑party providers; we ensure appropriate contracts and safeguards are in place.

12. Liability

12.1 We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence or for fraud.

12.2 Subject to 12.1, we are not liable for:

  • indirect or consequential loss;

  • loss of profits;

  • injury or damage arising from failure to follow instructions, unsafe lifting practices, or pre‑existing conditions you did not disclose.

12.3 You agree to follow all safety instructions and to use equipment responsibly.

13. Complaints & Feedback

Please raise concerns with a staff member or email [admin@gym13.co.uk]. We aim to acknowledge within 3 working days and respond within 10 working days.

14. Promotions & Referrals

Promotional offers are time‑limited, non‑transferable, and subject to separate terms published with the offer.

15. Intellectual Property & Media

15.1 Gym13 branding, content, and training materials may not be reproduced without permission.

15.2 Filming/photography must not infringe others’ privacy. Tripods, lighting, or commercial shoots require prior written approval.

16. Changes to These Terms

We may update these Terms to reflect operational, legal, or safety requirements. We will post updates on [www.gym13.co.uk] and, for material changes, notify active members by email with at least 14 days’ notice. Continued use after the effective date constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of England & Wales, and disputes are subject to the exclusive jurisdiction of the courts of England & Wales.
